Pingluo Bearing was Sentenced to Payment of 2.15 million yuan to Xibei Bearing(NXZ)

Xibei Bearing Co., Ltd.(NXZ Bearing) has authorized Pingluo Bearing Co., Ltd (abbreviated to Pingluo Bearing) to use its trademark and endorsement right in 2005, while sued the company to the court for usage fees problem in 2008. On Jan.16th, 2011, Pingluo was sentenced to payment of 2.15 million yuan to Xibei Bearing Co., Ltd because they didn't have sufficient evidence. On Jan. 31st, 2005, NXZ Bearing has signed "NXZ" Trademark and "Xibei Bearing" Endorsement License Contract with Pingluo Bearing, and stipulated that NXZ Bearing approbates Pingluo Bearing to use the "NXZ" Trademark and "Xibei Bearing" Endorsement; the period is one year, that is from Jan. 1st, 2005 to Dec. 31st, 2005. In Dec. 2008, NXZ Bearing sued Pingluo Bearing to the court for the problem on usage fees. In Feb. 2010, the first-instance court pronounced judgement that Pingluo Bearing should pay 150,000 yuan to NXZ Bearing for usage fees in ten days after the judegement became effective. But NXZ Bearing appealed against the first-instance judgement. Higher People's Court of Ningxia Autonomous Region judged the case and sentenced Pingluo Bearing to payment of 2.15 million yuan for NXZ Bearing for insufficient evidence.
